AAU and 23 higher education institutions submitted an amicus brief supporting The Ohio State University’s petition to the United States Supreme Court to overturn a decision issued by the U.S. Sixth Circuit Court of Appeals eliminating the statute of limitations for Title IX claims and extending Title IX remedies to any individual who visits a college campus. The brief argued that the ruling puts universities “in a serious fiscal bind” and “creates perverse incentives for institutions to avoid internal investigations to uncover misconduct.” Further, the brief argued that, if allowed to stand, the Sixth Circuit decision “will subject federal funding recipients to near-limitless liability that far exceeds what they agreed to under Title IX.”
