AAU Joins Comment Letter Outlining Concerns with DHS H-1B Rule

AAU joined ACE and 17 other multi-sector associations to submit comments on the Department of Homeland Security’s recent notice of proposed rulemaking titled “Modification of Registration Requirement for Petitioners Seeking To File Cap-Subject H-1B Petitions.” The letter outlines the associations’ concerns with the rule, which include: that wage prioritization as outlined in the rule is not permitted under the Immigration and Nationality Act; the rule does not exclude early-career Master or Bachelor degree recipients; the lack of sufficient factual basis to propose a new regulation; and more. According to the associations, the rule would instigate “a policy shift that is not permitted under the Immigration and Nationality Act’s (INA) statutory language and, even if lawful, proposes a prioritization construct that would be damaging to the economic success of the nation.”
