Orphan Works

Orphan works are copyrighted creative works for which the copyright holder cannot be identified. A major barrier to using such materials in new scholarly work is the possibility that the copyright holder will eventually come forward and sue the user for copyright infringement.

AAU supports legislation that would make such “orphan works” available for education and research contingent upon a diligent search for the copyright owner. Such legislation would require appropriate attribution to the authors and provide for reasonable compensation should the copyright owners be located.
